Terms of Service

These Terms of Service ("Terms") govern your use of Avatar Meet (avatarva.com, avatarva.com), Avatar Chat (avatarva.com, avatarva.com), and Avatar Message (avatarva.com, avatarva.com), collectively "AvatarVA" or "the Service," operated by CloudIntelligence.ai LLC ("we," "us," "our"). By using the Service, you agree to these Terms.

1. Service Description

Avatar Meet is a smart meeting scheduling tool. Your website visitors select a duration, answer tailored intake questions for your business type, pick an available time slot, and both parties receive a Google Calendar event with a Google Meet video link. Avatar Meet automatically scores leads and sends you a pre-meeting brief.

Avatar Chat is an intelligent AI chat assistant. It answers your visitors' questions using a knowledge base you provide (uploaded PDFs, CSVs, text files, or website crawl). The AI adapts its behavior based on your business type, page context, and visitor needs. When the AI cannot answer, it offers to schedule a call via Avatar Meet.

Avatar Message handles automated follow-ups, appointment reminders, and broadcast campaigns. It sends post-meeting thank-you messages, no-show re-engagement, booking confirmations, and promotional broadcasts to your customer list via email, SMS, Telegram, Slack, or WhatsApp.

AvatarVA is part of the CloudIntelligence.ai ecosystem, which also includes ToolsInfo.com, AI NewsCycle, and AIPapers.ai.

2. Accounts

• Accounts are created via Google OAuth. You must use a valid Google account.
• You are responsible for all activity under your account.
• You must provide accurate business information when creating your tenant profile.
• One tenant account per business entity.

3. Plans and Pricing

All plans include all three products (Avatar Chat, Avatar Meet, and Avatar Message). Plans differ in usage limits and features.

• Free — $0/month: 20 bookings/month, 50 AI chats/month, 50 messages/month, 2 documents, 5MB storage. "Powered by AvatarVA" branding shown.
• Pro — $8.99/month: Unlimited bookings, 1,000 AI chats/month, 500 messages/month, 10 documents, 100MB storage, semantic search, external DB. No branding.
• Pro+ — $14.99/month: Unlimited everything, 50K embedding chunks, 500MB storage, 5 external DBs. Priority support.

All paid plans are billed monthly via Stripe. You may cancel anytime with no cancellation fees. There are no long-term contracts. Refunds are available within 30 days of first payment if you are unsatisfied — contact us at [email protected].

4. Acceptable Use

You agree NOT to:

• Use the Service for spam, phishing, or any unlawful purpose
• Upload malicious content, malware, or harmful files to the knowledge base
• Attempt to circumvent plan limits or rate limiting through automated means
• Impersonate another person or business
• Use the Service to collect visitor data for purposes not disclosed to your visitors
• Resell or white-label the Service without our written consent
• Abuse the Google Calendar integration by creating spam events or excessive API calls
• Upload sensitive personal data (SSNs, credit card numbers, medical records, passwords) to the knowledge base

5. Your Content and Data

• You retain ownership of all content you upload (documents, business information, configurations)
• You retain ownership of all booking data and visitor information collected through your AvatarVA tools
• You grant us a limited license to process your content solely to provide the Service
• You are responsible for ensuring your use of visitor data complies with applicable privacy laws (GDPR, CCPA, etc.)
• You are responsible for the accuracy and legality of content uploaded to your knowledge base

6. Visitor Data Responsibility

When visitors interact with your AvatarVA chat or booking page, you are the data controller for the personal information they provide. You agree to: inform your visitors that their data is collected; have an appropriate privacy policy on your own website; handle visitor data in compliance with applicable laws; and not use visitor data for purposes beyond what visitors reasonably expect.

7. Google Calendar Integration

• By connecting Google Calendar, you authorize us to access your calendar's free/busy data and create events on your behalf
• You can disconnect at any time through your dashboard or Google Account permissions
• We are not responsible for Google Calendar outages or changes to Google's APIs

8. AI Chat (Avatar Chat)

• AI responses are generated using Google Gemini based on your uploaded knowledge base
• AI responses may occasionally be inaccurate, incomplete, or misleading. You are responsible for reviewing AI response quality
• We are not liable for decisions made by your visitors based on AI-generated responses
• You should not upload sensitive personal data to the knowledge base
• Conversation data is sent to Google Gemini API for processing — Google Gemini API Terms apply

9. Service Availability

10. "Powered By" Branding

Free plan users agree to display "Powered by AvatarVA" branding on their chat and booking widgets. Removing this branding without upgrading to a paid plan (Starter, Pro, or Business) is a violation of these Terms.

11. Termination

• You may delete your account and data at any time by contacting us
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted within 30 days. Calendar tokens are revoked immediately.

12. Limitation of Liability

To the maximum extent permitted by law, CloudIntelligence.ai LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: missed meetings due to notification failures, inaccurate AI responses, lost business opportunities, or service interruptions. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless CloudIntelligence.ai LLC from any claims, damages, or expenses arising from: your use of the Service, your violation of these Terms, your violation of any third-party rights, or content you upload to the knowledge base.

14. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of Orange County, California.

15. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance. We will notify users of significant changes via email or in-dashboard notice.
